These Terms & Conditions (“Terms”) govern your access to and use of the website, services, systems, messaging programs, and communications operated by The BOM Academy. (“The BOM Academy,” “we,” “our,” or “us”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

If operating under a DBA (Doing Business As), such relationship will be clearly disclosed in campaign descriptions and website documentation.

The BOM Academy provides legitimate business services including:

Automated Google Review systems

Review request messaging (where proper consent exists)

Consultation booking

Onboarding systems

Website design and optimization

Google Business Profile optimization

Search engine optimization (SEO)

Digital presence support

All Services are provided for lawful business purposes only.

The BOM Academy does not provide:

Lead resale services

Affiliate marketing campaigns

Third-party marketing distribution

Political messaging

High-risk financial messaging

SHAFT-related content


3. Eligibility

You must:

Be at least 18 years of age

Be legally capable of entering binding agreements

Use the Services for lawful purposes

By using the Services, you represent and warrant that you meet these requirements.


4. SMS Messaging Program Terms

4.1 Program Description

The BOM Academy may send SMS messages related to:

Consultation confirmations

Appointment reminders

Onboarding instructions

Account updates

Service-related notifications

Review system setup notifications

Follow-ups related to user-initiated requests

The BOM Academy does not send cold SMS outreach.

Messages are sent only where consent has been provided.


4.2 Consent to Receive Messages

By submitting a form and selecting an SMS consent checkbox, you agree to receive SMS messages from The BOM Academy. related to the services described at the time of opt-in.

Are optional

Are not pre-checked

Allow form submission without selection

Clearly disclose message purpose

Disclose message frequency

Disclose that message & data rates may apply

Include STOP and HELP instructions

Consent is not a condition of purchase.


4.3 Message Frequency

Message frequency varies based on user interaction and service engagement.

You may receive up to 3 messages per interaction, depending on your activity (e.g., booking confirmation, reminder, follow-up).

Messages are not sent on a recurring promotional basis unless you continue engaging with our Services.


4.4 Message & Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you.

If you have questions about your text or data plan, contact your wireless provider.


4.5 STOP Instructions (Opt-Out)

You can cancel the SMS service at any time.

To opt out, text STOP to the phone number from which you received the message.

After you send the SMS message “STOP” to us, we will send you an SMS confirmation message that you have been unsubscribed.

After this, you will no longer receive SMS messages from us unless you re-subscribe.

Opt-out requests are processed promptly.


4.6 HELP Instructions

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for assistance.

4.7 Carrier Liability

Carriers are not liable for delayed or undelivered messages.


5. Client Responsibility (For Business Clients Using Review Automation)

If you are a business client using The BOM Academy’ automated review systems:

You represent and warrant that:

You have obtained proper consent from your customers before providing their contact information

You comply with TCPA, A2P 10DLC, and applicable messaging laws

You have authority to share customer contact data for service-related messaging

The BOM Academy reserves the right to suspend or terminate services if misuse, illegal activity, or non-compliance is detected.


6. Data Sharing Restriction (Mandatory Non-Sharing Clause)

The following language governs all mobile and messaging-related data:

“No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.”

The BOM Academydoes not sell, rent, or distribute personal information.


7. User Responsibilities

You agree to:

Provide accurate information

Submit only contact information you own or are authorized to provide

Use the Services lawfully

Comply with all communication laws and regulations

You are solely responsible for the information you submit.


8. Third-Party Platforms

Our Services may integrate with third-party platforms including:

Google Business Profile

Hosting providers

Messaging infrastructure providers

Analytics tools

The BOM Academydoes not control third-party platforms and is not responsible for their policies, availability, or actions.

Use of third-party services is subject to their own terms.


9. Intellectual Property

All systems, designs, processes, software, branding, content, and materials are the property of The BOM Academyor its licensors.

No portion of the Services may be copied, reproduced, distributed, or exploited without written permission.


10. Service Limitations

The BOM Academydoes not guarantee:

Specific review counts

Specific rankings

Revenue increases

Platform visibility

SEO results

Results depend on external factors outside The BOM Academy’ control.

Services are provided on an “as is” and “as available” basis.


11. Termination

The BOM Academymay suspend or terminate access to Services if:

These Terms are violated

Misuse is detected

Legal or carrier compliance risks arise


12. Limitation of Liability

To the maximum extent permitted by law, The BOM Academyshall not be liable for indirect, incidental, consequential, or special damages arising from use of the Services.


13. Indemnification

You agree to indemnify and hold The BOM Academyharmless from claims, damages, losses, or expenses arising from:

Your misuse of the Services

Your violation of communication laws
